Pakistan's top court overruled ruling regarding Parliament's dissolution, restore Khan's government

ISLAMABAD (TSAT) - Pakistan's top court on Thursday overruled the President's order to dissolve the parliament and restored prime minister Imran Khan's government. 

 

In a unanimous decision by the five-member bench headed by the Chief Justice of Pakistan, has set aside the deputy speaker ruling to dismiss the no-trust motion against the Prime Minister Imran Khan. 

 

The supreme court also ruled that President Arif Alvi's decision to dissolve the National Assembly was "illegal" and restored Prime Minister Imran Khan as well as his cabinet.

The court also ordered to summon the National Assembly session on April 9 and process the no-trust motion against the Prime Minister.

"The deputy speaker gave a ruling on April 3. Leave was granted on the no-confidence motion on March 28. The ruling of the speaker is declared unconstitutional," said Justice Bandial in its order.

 

The court in it's verdict said that the government could not interfere in the participation of any member of parliament in the assembly session.

The court stated that the current order would not impact the proceedings under Article 63 of the Constitution.

"It is, however, clarified that nothing in this short order shall affect the operation of Article 63A of the Constitution and consequences thereof in relation to any member of the Assembly if he votes on the Resolution or (if such be the case) the election of a Prime Minister thereafter in such manner as is tantamount to his defection from the political party to which he belongs within the meaning of the said Article," the verdict reads.

 

The opposition parties called the verdict is it victory and called off their Friday protest across the country. 

"We announced black day on Friday but now we will celebrate the Friday as victory day," said Maulana Fazlurehman, President of PDM.

 

However, the ruling party chief Imran Khan also called an emergency meeting of his party for the next strategy.
